Terms of Service

These terms are the agreement between you and YUKUZ. They describe what the service does today, what it deliberately does not do, how subscriptions work, and the rights you keep whatever this document says.

The parts people most often need. You must be 18 or over. YUKUZ is software for writing down trading rules and reading research: it does not place orders, it cannot withdraw from your exchange, and it never holds your money or your crypto. Subscriptions renew monthly and you can cancel at any time from your account. Your rights under the Australian Consumer Law always apply, and nothing here tries to take them away.

1. Acceptance of these terms

These terms are an agreement between you and YUKUZ, ABN 39 679 009 646 ("YUKUZ", "we", "us"), the provider of the YUKUZ software and website. We are based in Canberra, Australian Capital Territory, Australia.

By creating a YUKUZ account, or by using the YUKUZ website or software, you agree to these terms. If you do not agree, please do not create an account and do not use the service.

If you are using YUKUZ on behalf of a company or another organisation, you confirm that you are authorised to accept these terms for that organisation.

2. Who may use YUKUZ

You must be at least 18 years old to use YUKUZ, and you must be legally able to enter into this agreement where you live.

You are responsible for making sure that your use of YUKUZ is lawful in your country. Cryptocurrency services are regulated differently from place to place, and some activities are restricted or prohibited in some countries.

We do not currently check your location or restrict access by country. We do not carry out identity verification, and we do not perform customer due diligence checks. If a restriction applies to you, it is your responsibility to comply with it.

3. Creating an account

To create an account you provide an email address and choose a password. We do not ask for your name, your postal address or your telephone number.

You must give an email address that you control, and you must keep it accurate. We send account emails to that address, including the verification link and any password reset link.

We ask you to verify your email address before you sign in. Until the address is verified, the account cannot be used.

4. Keeping your account secure

You are responsible for your password and for anything done through your account.

We provide security features that we recommend you use:

  • Two factor authentication using an authenticator app.
  • Single use recovery codes, issued once when you switch two factor on.
  • A list of your active sessions, which you can end individually.

Please store your recovery codes somewhere safe. Each code works once. We cannot recover a code for you, because we only store a hashed form and never the code itself.

Tell us promptly at support@yukuz.com if you believe someone else has used your account.

5. Verification and sign in

Signing in requires your email address and password. If you have enabled two factor authentication, it also requires a current code from your authenticator app or one of your recovery codes.

For your protection:

  • Repeated failed sign in attempts temporarily lock the account.
  • A code from your authenticator app can be used only once, so a code that someone observes cannot be reused.
  • Enabling two factor authentication requires your password again, so someone who has taken over a signed in browser cannot attach their own authenticator to your account.

6. What YUKUZ is

YUKUZ is software for people who want to write down trading rules clearly and keep research in one place. Today the service consists of:

  • Rule Bot Studio, where you describe a rule, for example a condition and the action you would take if it happened, and save that configuration to your account.
  • Exchange connections, where you may connect a supported exchange account using an API key so that YUKUZ can confirm the key works and read your balances.
  • The YUKUZ Intelligence Report, a monthly research document.
  • Market Watch, a public preview of what the current edition covers.

7. What YUKUZ is not, today

This section describes real, current limits of the software. Please read it before you subscribe.

  • Rule Bots do not trade. A Rule Bot is a saved configuration. Saving one does not cause anything to be bought or sold.
  • The runtime that would act on a rule is switched off. It is disabled by default in the software and is not enabled for customers.
  • Live trading is off.
  • YUKUZ cannot place or cancel an order. The exchange connector is built with read only capability. The ability to place orders is not merely switched off, it is not granted to the connector at all.
  • YUKUZ cannot withdraw from your exchange account. Withdrawal permission is not requested and is not supported.
  • Strategy Bots and Paper Lab are not available. They are described on the website as not yet available, and that is accurate.

We will not describe a capability as available before it exists. If and when execution becomes available, it will be announced, and the risk disclosure will be updated first.

8. Rule Bot configuration

You decide what your rules say. YUKUZ validates that a configuration is complete and internally consistent, and it refuses to save a configuration it cannot represent honestly. That validation is a correctness check. It is not a judgement that your rule is sensible, suitable for you, or likely to make money.

Configurations you save are yours. You may edit or delete them.

9. Connecting an exchange

If you choose to connect a supported exchange account, you give YUKUZ an API key that you create at the exchange.

  • Create the key with the narrowest permissions the exchange allows.
  • Do not enable withdrawal permission. YUKUZ does not use it and does not support it.
  • YUKUZ stores your key encrypted, and uses it only to check that the key works and to read your balances when you ask.
  • You may delete a stored credential or an entire connection at any time. Deleting a credential removes it from our database.

Your relationship with the exchange is between you and the exchange. Their terms, their fees, their availability and their security are theirs, not ours.

10. Plans and prices

YUKUZ is sold as a monthly subscription. The current plans are:

Plans differ in how many Rule Bots you may keep active, how many exchange connections you may hold, and how many trading pairs you may assign in total. The limits that apply to your plan are shown in your account and are enforced by the software.

Prices are in United States dollars.

11. Billing

Payments are processed by Stripe. You enter your card details on Stripe's own checkout page.

YUKUZ never receives or stores your card number. We store an identifier that links your account to your Stripe customer record, and we store the state of your subscription.

12. Recurring charges

A subscription renews automatically each month until it is cancelled. By subscribing you authorise the recurring charge for your chosen plan.

If we ever change the price of a plan you already hold, we will tell you before that change takes effect, and you will be able to cancel before it applies.

13. Cancellation

You can cancel from the Billing page in your account.

Cancellation takes effect at the end of the billing period you have already paid for. Your plan keeps working until then, and it is not renewed afterwards. We do not pro rate a partial month.

14. Failed payments

If a payment fails, your subscription enters a short grace period of three calendar days, during which your plan continues to work and you can update your payment details.

If payment is still not completed after the grace period, the subscription is suspended and plan features stop being available. Your account, your saved configurations and your data remain. Completing payment restores access.

15. Refunds

Your rights under the Australian Consumer Law always apply, and nothing in these terms limits them. If our service is not supplied with due care and skill, or is not reasonably fit for its purpose, you may be entitled to a remedy including a refund. Those rights cannot be excluded, and we do not try to exclude them.

Beyond those rights, we do not offer a general change of mind refund. If you cancel, your plan continues until the end of the period you have already paid for, as described in section 13, and we do not refund a partial month.

16. Free accounts

You can create a YUKUZ account without paying. A verified free account gives you access to the YUKUZ Intelligence Report.

Creating and configuring Rule Bots, and connecting exchanges, require a paid plan.

17. The YUKUZ Intelligence Report

The Intelligence Report is a monthly research document written and reviewed by a person at YUKUZ.

Access is included with any verified YUKUZ account, including a free one. No paid plan is required to read it. A public preview on the website shows which assets an edition covers and lists the sources it cites.

The report may change or stop. We do not promise a particular publication schedule as a contractual term.

18. The report is educational information

The Intelligence Report, the website, the demonstrations and anything else we publish are educational and informational only.

The report deliberately excludes price targets, forecasts, sentiment scores and numeric scenario ranges, and it says so in its own methodology section.

19. We do not give financial advice

Nothing YUKUZ provides is financial, investment, legal or tax advice.

We do not know your circumstances, your finances, your objectives or your risk tolerance, and nothing we publish is tailored to them. Nothing we provide is a recommendation to buy, sell or hold anything.

If you want advice, please speak to someone qualified and licensed to give it in your country.

20. We are not a broker or an exchange

YUKUZ is not a broker, a dealer, an exchange, a money transmitter or a financial institution. We do not execute trades, we do not match orders and we do not hold a market.

21. No fiduciary relationship

Using YUKUZ does not create a fiduciary relationship, an advisory relationship or an agency relationship between you and us. We do not act on your behalf in any market.

22. We do not hold your money or your crypto

YUKUZ never takes custody of your funds or your digital assets. Your assets stay in your own accounts at your own exchange. We cannot move them, and we cannot withdraw them.

The only money that moves between us is your subscription payment, which Stripe handles.

23. Exchange risk

Your exchange is a separate company. It can go offline, change its API, change its fees, restrict your account, be attacked, or fail. Any of those things can affect what YUKUZ can show you, and can affect your assets, and none of them is within our control.

24. Cryptocurrency risk

Cryptocurrency is volatile and speculative. You can lose money, including all of it. Please read the YUKUZ Risk Disclosure, which forms part of these terms.

25. Your decisions are yours

You are solely responsible for what you decide to do with your money, for the rules you write, for the assets you choose and for the exchange you use.

YUKUZ does not promise profit, income, or any particular result, and never will. Anyone who tells you otherwise is not speaking for us.

26. Availability

We aim to keep YUKUZ available and working well, but we do not promise uninterrupted service. Maintenance, upgrades, provider incidents and faults all happen.

We do not currently offer a service level agreement or an uptime commitment.

27. Third party services

YUKUZ depends on services we do not run, including Stripe for payments, Cloudflare for website hosting and delivery, Microsoft for sending email, the exchange you connect, and CoinGecko for the public price display on our homepage. Their behaviour and availability are outside our control.

28. Acceptable use

Please use YUKUZ for its intended purpose: configuring your own rules, managing your own connections, and reading our research for your own use.

29. Prohibited use

You must not:

  • break the law, or use YUKUZ to help someone else break the law
  • try to gain access to an account, system or data that is not yours
  • probe, scan or attack our infrastructure, or interfere with other people's use of the service
  • use another person's exchange credentials
  • resell, redistribute or republish the Intelligence Report, or share your account so that others can read it
  • copy the service, scrape it at scale, or use automated means to extract content beyond ordinary personal use
  • misrepresent YUKUZ, for example by claiming that we endorse an investment or that we promise returns

30. Intellectual property

The YUKUZ website, software, interface, brand and the Intelligence Report belong to us or to our licensors. Your subscription gives you permission to use the service, and to read the report for your own purposes. It does not transfer ownership of anything.

31. What you put into YUKUZ

Your configurations and settings remain yours. You give us permission to store and process them so that we can provide the service to you. We do not claim ownership of them and we do not sell them.

32. Suspension and termination

You may stop using YUKUZ at any time, and you may cancel your subscription as described in section 13.

We may suspend or close an account that breaches these terms, that is being used unlawfully, or where suspension is needed to protect other customers or our systems. Where it is reasonable to do so, we will tell you why.

Please note the current limits on deletion. YUKUZ does not yet provide a self service way to delete your account. To ask us to close your account, email support@yukuz.com and we will handle it manually.

Closing your account is not the same as erasing every record we hold, and some records, in particular security audit records, are kept in a form the application cannot delete. The Privacy Policy sets this out in full under "Your choices, and what we can honestly do today", and we would rather explain it than promise something the software does not do.

33. Disclaimers

Australian Consumer Law comes first. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have that cannot lawfully be excluded, restricted or modified. If anything in these terms would have that effect, it does not apply to that extent.

Subject to that, and to the extent the law allows, YUKUZ is provided "as is" and "as available", without other warranties, whether express or implied.

We do not warrant that the service will be uninterrupted or error free, that information will always be accurate, complete or current, or that using YUKUZ will produce any particular result.

34. Limitation of liability

This section applies subject to section 33. It does not limit any right or remedy that cannot lawfully be excluded, restricted or modified, including your rights under the Australian Consumer Law.

To the extent the law allows:

  • We are not liable for trading losses, lost profits, lost opportunity, or loss of data, however caused.
  • We are not liable for anything done or not done by a third party, including your exchange, Stripe, or any infrastructure provider.
  • Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, our liability is limited to resupplying the service or paying the cost of having it resupplied.

35. Indemnity

These terms contain no customer indemnity.

We do not ask you to cover our legal costs, our losses or a third party's claim against us.

36. Changes to the service

We continue to develop YUKUZ. Features may be added, changed or removed. If we remove something significant that you are paying for, we will tell you, and you will be able to cancel.

37. Changes to these terms

We may update these terms. If a change is significant, we will give reasonable notice before it takes effect, by email or in the product. Continuing to use YUKUZ after a change takes effect means you accept the updated terms.

38. Governing law

These terms are governed by the law of the Australian Capital Territory and the applicable law of the Commonwealth of Australia. You and we submit to the courts of the Australian Capital Territory, and to the courts able to hear appeals from them.

This clause does not take away rights you have elsewhere. If you live outside the Australian Capital Territory, or outside Australia, you may have rights under the mandatory law of the place you live that apply whatever this clause says. Nothing here is intended to displace those rights, and to the extent it would, it does not apply.

We will acknowledge a complaint and work with you to resolve it before either of us starts formal proceedings, except where urgent relief is needed.
